The OSX kernel (Darwin) is freely available and open-source.

http://sourceforge.net/projects/gnu-darwin/

The rest is commercial... I believe that if you are running 10.0 -- it is 
a cost upgrade...
(sorry...)

The current version is 10.1.5...
