[PD] is jMax free or not?

For comparaison, PD is released with a BSD styled license, which allows to 
modify and sell PD without the source code. The same applies to Tcl/Tk. 
So I guess it would be possible to embed a patch in a statically compiled 
PD binary and sell the result as a commercial product.
